About 100 former workers of the Rivers State Sustainable Development Agency have secured permission from the Court of Appeal in Port Harcourt to challenge a decision that prevented them from enforcing an earlier judgment on their unpaid salaries.
The workers say their salaries have remained unpaid since 2017 after they were disengaged from the agency. They had previously obtained a 2021 judgment from the National Industrial Court declaring that their employment remained in force until it was properly determined and directing payment of their salaries and other entitlements.
According to their legal representatives, the outstanding financial obligation has now exceeded three billion naira and continues to increase because the workers’ employment status has not been formally concluded. The workers subsequently returned to court seeking enforcement of the earlier judgment.
However, the National Industrial Court declined to grant the enforcement request, citing an appeal-related issue. The workers challenged that decision at the appellate court, arguing that there was no substantive appeal against the original judgment that should prevent enforcement.
After hearing arguments from both sides, the Court of Appeal granted the workers leave to proceed with their appeal. The case will now return to the appellate process, where the court is expected to determine whether the earlier judgment can be enforced and how the workers’ outstanding claims should be addressed.
